Welcome to Selah Terms of Service

By using any of the Services and the App, You expressly agree to be bound by these terms and all applicable laws and regulations governing the Site/App and the Services. The terms form a legally binding agreement between you and Selah in relation to your use of the Site/App and/ or the Services and applies to all users of the Services, whether registered or not, on the App. This Agreement is an electronic contract that establishes the legally binding terms you must accept to use the Service

As used in this Agreement, “www.regentech.io”, ”we," "us," and "our" shall mean Selah App and its subsidiaries and affiliates. By accessing or using the services available through our app (the "Services"), you agree to be bound by these Terms of Service and our Privacy Policy currently found at URL of (https://www.regentech.io/terms-of-service) and URL of (https://www.regentech.io/privacy-policy) and incorporated herein by reference. These Terms do not alter in any way the Terms of Service of any other agreement you may have with Selah App for products, services or otherwise. If you are using the Services on behalf of any entity, you represent that you are authorized to do so.

In case you are not comfortable with the app, services and features, we suggest you to STOP using the app. Your agreement with Selah App regarding the compliance of the terms, rules and regulations become effective immediately upon your usage of any feature of the app.

Selah App reserves all the rights to update or modify these terms anytime without giving any notice. As a user, it is your responsibility to review the app and these terms from time to time and make sure you comply with the new changes. Your continued use of the app implies your acknowledgement of the updated terms and conditions.

Selah App requires all users to be over the age of thirteen (13). We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate the child’s account.

You are responsible for your use of our Services, for any Content you Post using the Services, and for any consequences or liability arising therefrom. You should only provide Content you are comfortable sharing under this Terms of Service.

1. Third Party Sites and Information

1.1 You might find several third party links which may refer to some websites, apps, or other content provided by third parties. We do not control these parties and we are not liable for accuracy, legal compliance or any other aspect related to these sites. We have provided these links for merely as a convenience and it should not be assumed as any association or endorsement with these parties. Please read terms and conditions on their sites carefully before conducting any transaction with them.

2. Code of Conduct

We believe that coloring and community are the two things that complete each other. Thats what the Gallery is all about, it is a platform to share artworks and interact with each other. The aim of the Gallery is to build a community of colorists who can learn from each other and encouraging each other through art in a way thats relaxing.
We do our best in order to keep our app safe, however we do not provide any form of guarantee. We expect our users to keep the app safe and as a user, you agree to follow these rules:

2.1 The content you share should be appropriate for everyone from different age groups and from any kinds of backgrounds.
Do NOT post content that is:

Racist
Bullying, insulting, harassment, malicious comments
Any kind of hate speech, intimidation, false accusations
Pornographic or anything related thats inappropriate for younger audience
Disturbing or violent
Provocative, mocking, quarreling
Name-calling, ranting, stirring up controversy, venting frustrations.

2.2 You should not share or post:

Any private information such as passwords, credit card information, or any personal related information.
Anything illegal or copyrighted. Do not post any unlawful activities such as pyramid schemes.
Any images that comes from other coloring applications.
Other people’s coloring in your profile as your own. We highly honor people’s hard work in creating a coloring piece. You may learn a new skill or be inspired by the work of others but stealing, copying or plagiarism is unacceptable.
Rumors or accusations against Selah App or any of its users. If you see any bug or functions that isn’t working in Selah App or should you have any suggestions, please use the feedback button (“We ❤️ to hear from you”) in the Settings tab.
Spam. Do not post the same picture repeatedly. Do not constantly asking for likes or followers. Do not post any marketing schemes or advertisement for other sites / third party without a written consent from Selah App.

2.3 Selah App has the right but no obligation for taking action on any post or comments in the Gallery. Any picture / comments thats deemed inappropriate or unfinished (or almost empty) may be removed from the Gallery without prior consent.

2.4 If you found anyone who doesn’t follow the community guidelines, do not engage them directly. Instead report it to us through email to contact@regentech.io attaching the screenshot of the corresponding post / comment and we'll take the necessary action. Any user that is not abiding under these rules may be banned.

2.5 Selah App does not endorse, approve, or prescreen any content that you or other users post or communicate/comment on or through Selah App. Selah App does not assume any responsibility or liability for any content that is generated, posted or communicated by any user on or through the Selah App. You agree to indemnify Selah App and each of their respective employees, contractors, officers, directors, agents, representatives, vendors, and content providers from any liability or damages arising out of or resulting from any content you post or communicate on or through the Selah App

2.6 In no event shall the we, our affiliates or our partners be liable (directly or indirectly) for any losses or damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Service including, without limitation, death, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other users or persons you meet through the Service.
You understand that we make no guarantee, either express or implied, regarding your ultimate compatibility with individuals you meet through the Service. You should not provide your financial information (for example, your credit card or bank account information), or wire or otherwise send money, to other users. You agree that any Content you place on the Service may be viewed by other users and may be viewed by any person visiting or participating in the Service.

3. Publish Limits

3.1 To prevent flooding of the server we have publish limits as follows:

Regular users may publish 5 pictures per day
Pro members may publish 25 pictures per day

4. Intellectual Property Information:

4.1 By accepting the terms mentioned in this agreement, the user agrees that any kind of material that is presented on the website is completely protected by copyrights, service marks, trademarks, proprietary laws and regulations and Selah App is the sole owner of these materials.

4.2 In case a user color our artworks and share them on social media, we reserve the right to use those artworks for advertising and marketing purposes. The use of these artworks by users is strictly personal and we do not allow users to sell our artworks commercially without our written permission.

5. Subscription / Auto-renewal

5.1 The subscription is now called PRO membership.

5.2 The benefits of PRO membership are:

Access to all available artworks and additional new artworks per month. The number of new artworks given per month may vary but may up to 80 new artworks per month.
Access to all color palettes.
Access to all music.
Access to all coloring tools in the Coloring Page of the app.
For more information about PRO membership, please refer to the Selah FAQ page that you can access from the app starting from version 2.0.1.

5.3 We offer 7 days free trial to our users and after this time period, you will be charged $2.99 /week.

5.4 For a yearly subscription, you will be charged an equivalent of $59.99 / year and for a monthly subscription, you will be charged an equivalent of $9.99 / month.

5.5 Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.

5.6 Please check the following procedure to turn off Auto-Renewal:

For Subscription with iTunes:

Open Settings tab
Tap on "iTunes & App Store"
Tap on "Apple ID: User Name"
Tap on View Apple ID
Tap on Subscriptions (or for older versions of iOS: In Account Settings under Subscriptions, Tap Manage)
Tap on Selah
Here you can manage your subscription or stop it by Turning off "Auto Renew"

For Subscription with Google Play

Please note that you might have slightly different menu outlook due to different versions of Android and different devices. However, here are the general steps to manage your subscription:

Open the Google Play Store on your Android Smartphone or tablet.
Open the My Apps section via the Google Play Store menu. The menu usually can be toggled by tapping on the three lines or three dots located on the top right or left corner of the screen.
To the left of Installed apps is a list of your subscriptions.
Tap on Selah. And here you can manage the subscription or to cancel just tap on the ‘Cancel' button and confirm the action by tapping Yes.

5.7 Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase. See instructions in point 5.4 above for more information.

5.8 No cancellation of the current subscription is allowed during active subscription period

5.9 Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication.

5.10 As a user you understand that no any refund is given on purchases.

6. Changes to the Previous Memberships

6.1 Both Deluxe and Premium memberships will not be available for purchase starting from the app version 2.0.1 onwards. However, all existing members will not lose their membership access in any app version.

6.2 If you purchased the Deluxe membership, which was an all-access subscription, you will still pay the same amount as the time you first subscribed to it and retain your access.

6.3 If you purchased a Premium membership, which was a partial access membership with a one time payment, there will be no additional fees you need to pay and retain your access.

6.5 By continuing to use the app you have read and expressly agreed to the changes in this Term of Service and the "Changes In The App" as mentioned in point 6.4 above. If you are not satisfied in anyway, please send us an email to contact@regentech.io.

7. Disclaimer of Warranties

ALL THE PRODUCTS, SERVICES AND MATERIALS THAT ARE OFFERED ON THIS APP ARE PROVIDED ON "AS IS" MANNER AND WE DO NOT PROVIDE ANY FORM OF WARRANTY EITHER IMPLIED OR EXPRESSED, INCLUDING BUT NOT LIMITING THE KIND OF IMPLIED GUARANTEES THAT COULD BE RELATED TO MERCHANTABILITY OR ANY OTHER PURPOSE. OUR APP AND WEBSITE MIGHT INCLUDE SOME TECHNICAL OR OTHER FORM OF MISTAKES, INACCURACIES OR GRAMMATICAL ERRORS. SELAH APP RESERVES THE RIGHT TO MAKE ANY ALTERATIONS TO THE MATERIALS AND SERVICES OFFERED ON THIS APP AT ANY TIME.

THE UTILIZATION OF THE SERVICES OFFERED ON THIS APP, OR DOWNLOADING ANY KIND OF MATERIAL VIA THIS APP IS PERFORMED AT YOUR RISK AND WE ARE NOT RESPONSIBLE FOR ANY DAMAGE THAT MIGHT OCCUR TO YOUR COMPUTER AND ANY OTHER DEVICE YOU MIGHT USE TO ACCESS OUR APP. WE ARE NOT LIABLE FOR ANY LOSS OF DATA THAT COULD RESULT FROM SUCH ACTIVITIES.

8. Termination of Use

The users agree that Selah App reserves the right (in our sole discretion) to suspend or terminate your access to our app (or any part of the site) without issuing a notice. We may take this action for any reason, including but not limited to the violations of these terms and conditions. We do not tolerate any form of fraudulent activity, abuse and other illegal activities and your account will be terminated as soon as we suspect such activities occurring on your account.

9. Governing Law

As a user, you agree to follow and comply with all local, state and national laws, rules and regulations that are applied to you when you utilize our services.
